A legal disclaimer

1. Agreement Overview

These Terms & Conditions (“Agreement”) govern all rentals of party equipment from Pop-Up Party Des Moines, operated by PopUpPartyDesMoines LLC, an Iowa limited liability company. By placing a booking or making a deposit, you (“Renter”) acknowledge that you have read, understood, and agree to be bound by this Agreement.

This Agreement is entered into between PopUpPartyDesMoines LLC and the Renter identified in the booking confirmation.

2. Reservations & Deposits

All equipment rentals must be reserved in advance through our booking system. Availability is not guaranteed until a booking is confirmed in writing and a deposit has been received.

A non-refundable deposit of 50% of the total rental fee is required to secure your reservation.
Reservations are confirmed only upon receipt of the deposit and written confirmation from Pop-Up Party Des Moines.
Bookings are subject to availability and may be declined at our discretion.
Date changes are subject to availability and must be requested at least 7 days before the original event date.

3. Payment

The remaining balance is due 72 hours before the scheduled delivery or pickup time. Failure to pay the remaining balance by this deadline may result in cancellation of your reservation without refund of the deposit.

We accept major credit/debit cards and other payment methods listed at checkout.
All prices are listed in U.S. dollars and are inclusive of applicable Iowa sales tax where required.
Additional charges may apply for extended rental periods, excessive cleaning, or equipment damage (see Section 7).

4. Cancellations & Refunds

Deposits are non-refundable. Cancellations made with fewer than 72 hours’ notice forfeit the full payment.

More than 7 days before event: Deposit is forfeited; any additional payments are refunded.
3–7 days before event: Deposit is forfeited; 50% of remaining balance is refunded.
Less than 72 hours before event: No refund. Full payment is forfeited.
Pop-Up Party Des Moines reserves the right to cancel a booking due to circumstances beyond our control (see Section 9). In such cases, a full refund or credit will be issued.

5. Delivery, Setup & Pickup

Delivery, setup, and pickup logistics are confirmed at the time of booking. The Renter is responsible for ensuring that:

The event location is accessible for our vehicle and equipment on the scheduled date and time.
Adequate space and, where applicable, power sources are available for equipment operation.
Any required permits (HOA approval, park permits, etc.) have been obtained prior to delivery.
A responsible adult (18+) is present to accept delivery and sign the equipment condition form.

Additional delivery fees may apply for locations outside our standard service area. Delivery zones and fees are disclosed at the time of booking.

6. Renter Responsibilities

The Renter assumes full responsibility for rented equipment from the time of delivery until pickup. This includes:

Using all equipment only as intended and in accordance with any provided instructions.
Keeping equipment dry and protected from inclement weather unless specifically rated for outdoor use.
Preventing unauthorized use by persons not covered under this Agreement.
Not relocating equipment to a different address without prior written consent.
Ensuring children are supervised by responsible adults at all times while using rented equipment.
Not permitting use of equipment by individuals who are intoxicated or impaired.

7. Damage, Loss & Cleaning

The Renter is financially responsible for any damage, loss, or theft of equipment during the rental period. Equipment is inspected before delivery and upon pickup.

Minor cleaning is included in the rental fee. Excessive soiling (food, stains, biological material) may incur a cleaning fee of up to $75.
Damage beyond normal wear and tear will be assessed and billed at repair or replacement cost.
Lost or stolen equipment will be charged at full replacement value.
The Renter will be notified of any damage charges within 48 hours of equipment return, along with photographic documentation.

We recommend reviewing the equipment condition checklist at delivery and noting any pre-existing damage on the intake form.

8. Age Requirements & Supervision

The Renter must be at least 18 years of age to enter into this Agreement. All equipment involving physical activity (laser tag, bounce structures, etc.) must be used under continuous adult supervision. PopUpPartyDesMoines LLC is not responsible for injuries resulting from unsupervised or improper use.

Maximum participant capacity and age/weight guidelines provided for specific equipment must be observed at all times.

9. Weather & Force Majeure

Iowa weather can be unpredictable. Pop-Up Party Des Moines reserves the right to cancel or reschedule deliveries due to severe weather conditions (high winds, lightning, heavy rain, snow, or ice) that pose a safety risk or may damage equipment.

If we cancel due to weather, you will receive a full refund or free reschedule at your choice.
If the Renter chooses to cancel due to weather after equipment has been delivered, standard cancellation terms apply.
We are not liable for cancellations caused by acts of nature, government orders, or other circumstances beyond our reasonable control.

10. Limitation of Liability

To the maximum extent permitted under Iowa law, PopUpPartyDesMoines LLC’s total liability to the Renter for any claim arising under this Agreement shall not exceed the total amount paid by the Renter for the rental in question.

PopUpPartyDesMoines LLC is not liable for indirect, incidental, special, or consequential damages, including but not limited to event disruption, personal injury arising from improper use, or third-party claims.

By renting equipment, the Renter agrees to indemnify and hold harmless PopUpPartyDesMoines LLC, its members, employees, and agents from any claims, damages, or expenses arising from the Renter’s use of the equipment.

11. Governing Law & Disputes

This Agreement is governed by the laws of the State of Iowa. Any disputes arising under this Agreement shall be resolved in the courts of Polk County, Iowa, or through binding arbitration at the mutual written agreement of both parties.

If any provision of this Agreement is found to be unenforceable, the remaining provisions remain in full force and effect.
